BMC Boatyard Policies

Rev. 5/1/2024

Please read and check off each item, indicating your understanding and agreement to follow these policies for the any do-it-yourself (DIY) work at Berkeley Marine Center. Failure to follow these policies will result in loss of yard privileges and immediate launching of your boat.

Policy

  •  1. LAY DAY CHARGES     Lay days are $2.50 per foot per day for the first 2 weeks and increase by $0.50 per foot per day each succeeding 2 weeks. There is no lay day discount for foul weather or holidays. If you need BMC to do any work on your boat, come to the office and add the job to your work order. You will continue to accrue lay day charges during BMC work on your boat unless BMC technicians work on your boat more than 400 hours in a day.  (Boats under 15 ft are charged $30 per day.)
  •  2. DO NOT REMOVE OR ADJUST THE CRADLE BLOCKING (BOAT STANDS) FOR ANY REASON.
  •  3. PAINTING BOAT STAND SPOTS     Be prepared to paint where the cradle blocking was and/or the bottom of your keel when your boat is hanging in the slings prior to launch. This is boat bottom paint and can cure under water shortly after application.
  •  4. MOVE STANDS FEE    If you want the boat stands moved so you can paint prior to lifting your boat, there is a $30 fee. This service is available Monday through Friday only.
  •  5. SANDER RENTAL     FESTOOL Vacuum Sanders with a HEPA filter are the only sanders approved for use at the Berkeley Marine Center. If you have this exact sander, you may use your own, otherwise, BMC has sanders for rent during business hours.
  •  6. SANDER RETURN TIME     Return the FESTOOL vacuum sander to the Employees Only door by 4:45 PM and tell the front desk you have returned the sander.
  •  7. SANDER USE    Use the FESTOOL vacuum sander head FLAT against the boat hull or the surface you are sanding. Do not use the edge of the sander for grinding, this will ruin the $1000 sander. Transport the sander using the handles or sides, do not pull the sander by the hose or the electrical cord. Do not lift the sander on to your boat without the assistance of BMC yard staff. Return the sander to the office if it is raining, even lightly.
  •  8. PARKING     Park your car only in designated parking spots in the lot nearest the marina. DO NOT park your car anywhere in the boat yard or along the building. If the lot is full, park your car outside the BMC yard along the road.
  •  9. OUTSIDE CONTRACTORS    You may not hire non-BMC employees or contractors to work on your boat without prior approval from Berkeley Marine Center. Any approved contractor working on your boat must provide BMC with proof of a $1M liability insurance policy naming Berkeley Marine Center, Inc. as additional insured.
  •  10. LADDERS    Boat owners may use the yard’s ladders. You may use any ladder that is not tied to a boat or currently being used. Please inspect the ladder for safety before using. You must secure the ladder to your boat during your stay. By initialing this statement, you agree to hold BMC harmless for any injury resulting from ladder use.
  •  11. PROHIBITED ACTIVITIES     Do-It-Yourself (DIY) customers may not spray paint, cut, weld, or sandblast.
  •  12. CUSTOMER-SUPPLED PAINTS     All coating materials (primers, paints, solvents, etc.) must be legally approved for use in California and must be in their original containers with original labeling. You must tell the front desk the brand and name of the paint you are applying. There is a $20 “corkage” fee for each gallon of paint not purchased from BMC.
  •  13. PAINT CONTAINER DISPOSAL     Empty paint containers may be disposed of in dumpsters ONLY AFTER contents have been thoroughly dried.
  •  14. BMC TOOLS     BMC does not rent or loan tools under any circumstance except for the FESTOOL vacuum sanders and shop vacuums.
  •  15. WORKSITE     The area under the boat must be cleaned daily. There is a daily charge of $50.00 for every day there is trash or clutter under your boat. There are trash cans located throughout the yard. Please use them.
  •  16. WATER USE     You may not wash your boat or have water running off your boat onto the ground. This violates environmental regulations and risks a hefty fine.
  •  17. PARTICLE COLLECTION     A tarp MUST be placed under your work area if you are noticing anything falling onto the ground or onto your clothing. The tarp and the ground under the tarp must be vacuumed with a vacuum sander or BMC shop vac to pick up any stray particles. No paint chips or dust are to be put into the dumpsters or trash cans. Contact the yard manager to request use of a shop vac.
  •  18. HAUL/LAUNCH WAIVER     Berkeley Marine Center is not liable for any damage to your vessel due to its inability to withstand a normal haul and/or launch due to its age, construction or design.
  •  19. BOAT ACCESS     It is important that we have access to your boat’s cabin during launch (especially if any thru-hull work has been done) to ensure the boat is not taking on water. Please leave your keys with the staff in the chandlery or lock combination on the work order you fill out.
  •  20. STAYING ON YOUR BOAT     BMC allows you to stay on your boat while it is in the yard, if necessary. You may not have any liquids released from your boat, including faucet water, while you are in the yard.  By initialing this statement, you agree to hold BMC harmless for any injury resulting from you staying on your boat.
  •  21. HELPERS     If you have family or friends helping with your project, each of them must sign a copy of this Boatyard Policies document. Anyone under 18 years of age must be directly supervised by a parent or guardian.
  •
  • LIMITATION OF LIABILITY    Berkeley Marine Center (Center) shall not be responsible for: (A) Any loss of or damage to vessels; or (B) Any loss or damage to any articles, equipment or personal property; Or (C) Personal injury or death of owner, his employees, guests, agents or representatives, even if any such losses, injuries or deaths are caused by the fault or negligence of Center. Center will only be responsible if any losses, injuries or deaths are solely caused by Center’s willful misconduct or gross negligence. Center will not be responsible for any consequential or punitive damages.
